Terms of Service

These terms are an agreement between you and Odd Hour Labs LLC ("YogaLib", "we", "us"). They cover your use ofyogalib.net and every teacher's site on it. By signing in, buying or selling on YogaLib, you agree to them and to our Privacy Policy. If you don't agree, please don't use YogaLib.
1. What YogaLib is
YogaLib gives yoga teachers their own sites for selling recorded classes. The teacher is the seller. When you buy a class, you buy it from the teacher, through the teacher's own Stripe account. YogaLib provides the software and takes a fee from the teacher.
You must be 18 or older to use YogaLib. If you let a child watch a class you bought, you are responsible for supervising them.
2. Your health and safety
Yoga is physical activity and carries a risk of injury. Classes on YogaLib are for general education and are not medical advice. Talk to your doctor before starting a new practice, especially if you are pregnant, have an injury or have a medical condition. Practice within your own limits, in a safe space, and stop if anything hurts. A recorded class can't see you or correct you.
You take part at your own risk. To the fullest extent the law allows, YogaLib is not responsible for any injury or loss that results from practicing along with a class. Teachers are responsible for their own instruction.
3. For students
- Your account is your email address. Keep access to it secure, because whoever can read your email can sign in as you.
- Rentals last for the period shown when you buy, starting when your payment completes. This is also true for gifts.
- Purchases with no expiry give you access for as long as the teacher offers the class on YogaLib.
- Refunds are up to the teacher, because they are the seller. Contact them using the email address on their site. If a purchase is refunded or disputed, access to it ends.
- Personal use only. Please don't share your account, or record, download, copy, stream or re-post classes. Classes belong to the teachers who made them.
4. For teachers
Payments and Stripe
Payment processing services for teachers on YogaLib are provided by Stripe and are subject to the Stripe Connected Account Agreement, which includes the Stripe Terms of Service (together, the "Stripe Services Agreement"). By agreeing to these terms or continuing to sell on YogaLib, you agree to be bound by the Stripe Services Agreement, as Stripe may change it from time to time. For YogaLib to enable payments through Stripe, you agree to give YogaLib accurate and complete information about you and your business, and you authorize YogaLib to share it and your transaction information with Stripe.
You are the seller
Your students buy from you. You are responsible for your prices, your refund policy, answering your students, handling disputes, and any taxes on your sales.
Our fee
Our fees are shown on our pricing page, or as agreed with you in writing, and are collected automatically from each payment. Stripe may charge extra for some payments, such as international cards or disputes. Our fee is not returned when you refund a sale or lose a dispute. We'll give you advance notice before we change our fees.
Your content
You keep ownership of your classes and everything you add to YogaLib ("your content"). You give us permission to use it as needed to run and improve YogaLib for you and your students, including making versions of it such as captions. This permission is non-exclusive, worldwide and free of charge, and it ends when you remove your content. We don't sell your content or use it to train models.
You promise that you have the right to sell your content. This includes permission from anyone who can be seen or heard in it, such as students in a recorded class, and that your content doesn't break the law or anyone else's rights.
Your students' information
You'll see your students' email addresses and purchases. Use them only to run your classes and support your students, and follow the privacy and email marketing laws that apply to you.
Your videos
Your videos are stored with the video hosting service you use, under your own account and that service's terms. You're responsible for that account, including setting your videos to play only on your YogaLib site.
Leaving
You can stop using YogaLib at any time, and we'll help you export your student list. If we ever decide to shut YogaLib down, we'll give teachers reasonable notice.
5. Things you may not do
- Break the law, or infringe anyone's copyright, privacy or other rights.
- Upload anything harmful, deceptive, hateful or sexually explicit.
- Try to get around payments, access limits or security, or access other people's accounts.
- Overload, scrape or disrupt YogaLib.
If someone breaks these terms, we may remove content or suspend their account. Where we reasonably can, we'll tell them first.
6. Copyright complaints
If you believe something on YogaLib infringes your copyright, send a notice to our copyright agent at 455 Market St Ste 1940, San Francisco, CA 94105 or hello@yogalib.net. Include:
- the work you believe is infringed;
- where the material is on YogaLib;
- your contact details;
- a statement that you believe in good faith the use is not authorized;
- a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner;
- your signature.
We remove material that infringes copyright, and we close the accounts of repeat infringers.
7. Other services
YogaLib relies on services run by others, such as Stripe for payments and your video hosting service. Their own terms apply to your use of them, and we're not responsible for them.
8. Disclaimers
We work hard to keep YogaLib running well, but it is provided "as is", without warranties of any kind, to the fullest extent the law allows. We don't promise that it will always be available or free of errors. We're not responsible for the content of teachers' classes.
9. Limits on liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential losses, or for lost profits, revenue or data. Our total liability for any claim about YogaLib is limited to the greater of $100 or the fees you paid us in the 12 months before the claim. Nothing in these terms limits liability that the law does not allow to be limited.
10. Indemnity
If you're a teacher and a claim is brought against us because of your content, your sales or your breach of these terms, you agree to cover our reasonable costs and losses from that claim.
11. Disagreements
If you have a problem with YogaLib, email hello@yogalib.net first. Most problems can be sorted out quickly that way. If we haven't resolved it within 30 days, either of us may take it to small claims court, if it qualifies, or to the state or federal courts in California. The laws of the State of California govern these terms, apart from its conflict-of-laws rules. If you live outside the United States, you also keep any protections that your local consumer law gives you.
12. Changes to these terms
We may update these terms. If a change is significant, we'll email teachers and post a notice before it takes effect. If you keep using YogaLib after that, you accept the new terms.
13. General
These terms and our Privacy Policy are the whole agreement between you and us about YogaLib. If any part of them can't be enforced, the rest still applies. If we don't enforce a part right away, we haven't given up the right to enforce it later. You may not transfer these terms to anyone else without our consent. We may transfer them as part of a merger or sale of YogaLib.
